The Company provides professional structural surveying and engineering services limited to the scope agreed in writing with the Client. Services are based on visual inspections and information reasonably available at the time of the commission, unless expressly stated otherwise.
Any matters outside the agreed scope, including but not limited to concealed elements, specialist testing, or non-structural disciplines, are excluded unless separately instructed and agreed.
2. Standard of Care
All services are carried out with reasonable skill and care in accordance with:
Generally accepted UK engineering practice
Applicable Building Regulations and relevant standards
The information available at the time of inspection or design
No guarantee is given that defects will be identified where access is restricted or where elements are hidden from view.
3. Site Access and Limitations
Inspections are non-intrusive unless otherwise agreed.
The Company does not remove finishes, lift floor coverings, open up structures, or disturb services.
Where access is restricted, unsafe, or unavailable, conclusions will be based on reasonable assumptions, which may affect findings and recommendations.
4. Information Provided by the Client
The Company is entitled to rely on information, drawings, reports, and records provided by the Client or third parties. The accuracy of such information is not independently verified unless specifically stated.
The Company accepts no responsibility for inaccuracies arising from incomplete, incorrect, or withheld information.
5. Opinions, Judgement, and Future Performance
Engineering assessments and advice represent professional opinion at the time of issue.
They do not constitute a prediction of future performance, movement, or deterioration.
Conditions may change due to time, weather, loading, workmanship, or subsequent alterations beyond the Company’s control.
6. Use and Reliance on Reports
Reports and calculations are prepared solely for the Client and for the stated purpose.
They may not be relied upon by third parties without the Company’s prior written consent.
Unauthorised reliance by third parties is at their own risk.
7. Regulatory and Statutory Approvals
Where applicable, designs are prepared to support Building Control approval.
Final acceptance, approval, or interpretation of compliance rests with the relevant statutory authority.
The Company cannot guarantee approval decisions made by third parties.
8. Construction and Contractor Responsibilities
The Company does not supervise construction unless explicitly agreed in writing.
Responsibility for:
Workmanship
Temporary works
Site safety
Sequencing and methods
remains with the contractor and/or Client at all times.
9. Variations and Additional Services
Any changes to the agreed scope, design, or assumptions may require revisions and may result in additional fees and time.
No variation is valid unless confirmed in writing.
10. Fees and Payment
Fees are payable in accordance with the agreed terms.
Reports, calculations, and drawings may be withheld until payment is received in full.
11. Complaints and Resolution
The Company is committed to professional service.
Any concerns should be raised promptly to allow resolution in a reasonable and proportionate manner.
12. Liability
The Company’s liability shall be limited to losses arising directly from a proven failure to exercise reasonable skill and care in accordance with UK professional standards.
Liability shall not extend to:
Consequential or indirect losses
Losses arising from misuse or unauthorised reliance
Works executed contrary to the Company’s advice
13. Professional Indemnity
The Company maintains appropriate Professional Indemnity Insurance in accordance with UK practice.
14. Governing Law
